1. Provision of Service

These terms govern the use of the website, mobile application, and all associated services provided by the Developer of Game Genius Gen ("the Developer") (collectively, "the Service").

The Service is built using APIs and foundation models provided by third-party AI providers, including Hangzhou DeepSeek Artificial Intelligence Co., Ltd. ("DeepSeek"). By using the Service, you agree to comply with these terms as well as the DeepSeek Open Platform Terms of Service. By accessing the Service, you are deemed to have agreed to these terms.

3. AI Output and Copyright

• Ownership: Copyright of original portions of UGC (excluding third-party libraries and assets) belongs to the user. You may export the code and use, publish, or monetize your creation externally at your own risk, provided you comply with the terms of our AI providers (e.g., DeepSeek Open Platform Terms). The Service disclaims all liability for any legal disputes, malfunctions, or infringements arising from your external use or monetization. However, generated outputs may not necessarily qualify for copyright or other intellectual property protection under applicable laws. The Developer does not warrant or guarantee that any intellectual property rights will be established for the generated outputs.
• Service IP: All intellectual property rights related to the Service, including trademarks, logos, programs, and algorithms, belong to the operator or its licensors. Users are prohibited from secondary use, trademark registration, or reverse engineering of these assets without authorization.
• License: You grant the Service a perpetual, royalty-free license to host and promote your UGC within the Arcade.
• AI Disclosure: When publishing externally, you must disclose that it is AI-generated and may contain inaccuracies.
• No Warranty (Hallucination): We provide AI-generated content "as-is." You acknowledge the risk of "hallucinations" (plausible but inaccurate info) and agree that we provide no warranty regarding accuracy or safety. Furthermore, AI-generated content does not constitute professional advice (medical, legal, financial, etc.), and all decisions or actions based on the output are the sole responsibility of the user.
• User Responsibility for Third-Party Infringement: Users warrant that the input data and the generated outputs do not infringe upon the copyrights, portrait rights, or any other rights of any third party. In the event of any dispute or trouble arising from the infringement of third-party rights by the input data or generated outputs, the Developer shall bear no liability, and the user shall resolve such issues at their own expense and responsibility.

4. Prohibited Actions

• Reverse engineering, decompiling, or using data (such as code or programs) output from the Service for the purpose of training other AI or machine learning models.
• Attempting to bypass, spoof, or disable the Service's security constraints (including sandbox restrictions or external link filters on generated code).
• Entering data (prompts, assets, etc.) that infringes upon third-party intellectual property, portrait rights, privacy, reputation, or other rights, or generating/sharing UGC that infringes these rights.
• Entering prompts or generating/sharing UGC that is violent, grotesque, sexual, discriminatory, or otherwise violates public order and morals.
• Generating, distributing, or sharing UGC that constitutes phishing, credit card fraud, spoofed login UIs, unauthorized extraction of personal data, or malicious programs such as computer viruses.
• Processing or using end-user personal data collected through the Service without providing a proper privacy policy or violating applicable privacy laws.
• Implying any unauthorized partnership, agency, or official endorsement by the Service or its AI providers (e.g., DeepSeek).
• Any other actions deemed inappropriate by the Developer.

5. Changes to Terms

• The Developer reserves the right to modify these terms to reflect legal changes, new features, or operational needs.
• In the event of material changes, we will provide reasonable notice through the Service, within the app, or in the app store listings prior to the effective date.
• Minor changes (such as fixing typographical errors or clarifying expressions that do not cause disadvantage to users) shall take effect immediately upon being posted on the Service.
• Continued use of the Service after the effective date of the modified terms constitutes acceptance of the new terms.

6. Advertisements and Rewards

Users can earn "Rewards" such as extra project slots or repair tickets by watching video advertisements within the Service.

• Rewards are free benefits provided by the Service and do not constitute legal rights or property.
• The Service reserves the right to change or terminate the content, conditions, or expiration of rewards at any time without prior notice at the sole discretion of the Developer. We shall not be liable to compensate or refund any expired or lost rewards for any reason whatsoever.
• We are not liable for any failure to grant rewards due to technical issues or network errors.
• The use of automated viewing tools (Bots), macros, emulators, or any other fraudulent methods to improperly acquire rewards or bypass advertisements is strictly prohibited. Upon discovery of such unauthorized actions, the Developer reserves the right to suspend the user's account, confiscate acquired rewards, and restrict future access to the Service without prior notice.
• Trading, selling, or cashing out rewards is strictly prohibited.

7. Disclaimer and Termination

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding its completeness, accuracy, or fitness for a particular purpose.

The Service is not liable for any damages or losses (including those arising from playing shared games on the Web or within the Arcade). We may suspend or terminate the Service at any time without prior notice.

• To simplify the user registration process, the Service employs an anonymous authentication method tied to the device. Consequently, deleting the application (uninstalling), loss or failure of the device, or changing device models may result in the complete and permanent loss of all user data, including project data, chat histories, and earned rewards. The Developer is under no obligation to recover, migrate, or compensate for any lost data, and the management of such data remains the sole responsibility of the user. Furthermore, due to the nature of anonymous authentication, once the application is uninstalled, it is technically impossible for the Developer to identify, verify, or manually delete individual user data (uninstallation revokes access and renders the account permanently inactive). If you wish to permanently erase all your data from our systems, you must perform the "Delete All Data" action from the in-app settings BEFORE uninstalling the application.
• The Developer makes no representations or warranties regarding the legality, safety (including the absence of errors, bugs, or security vulnerabilities), or non-infringement of third-party rights for any games, code, images, or content generated, shared, or published by users (collectively, "User-Generated Content" or "UGC"). The Developer disclaims all liability for UGC.
• If a user (intentionally or negligently) violates these terms—including but not limited to copyright infringement, constructing phishing/fraudulent UIs, delivering unauthorized or harmful programs, or interfering with system operations—and causes disputes with third parties, the user shall resolve such disputes at their own expense and liability. If the Developer incurs any damages, losses, or expenses (including compensation, settlement payouts, and reasonable attorney's fees) arising from the user's conduct or UGC, the user shall fully indemnify and compensate the Developer for all such costs.
• The Developer shall bear no liability for any loss, deletion, or unavailability of project data, chat histories, rewards, or any other data resulting from the termination, interruption, modification, or malfunction of the Service. Users shall create and save backups of their project data and other assets at their own responsibility, and the Developer bears no obligation to create or maintain backups of any user data.
• Limitation of Liability: Notwithstanding any other provision of these Terms, if the Developer is found liable to a user for damages in connection with the Service, such liability shall (except in cases of the Developer's willful misconduct or gross negligence) be limited to direct and ordinary damages actually incurred by the user. The Developer shall not be liable for any special, indirect, incidental, or consequential damages (including loss of profits, data loss, or business interruption), regardless of foreseeability. In all events, the Developer's total cumulative liability shall not exceed 1,000 JPY.
• Cleanup and Deletion of Inactive Accounts and Data: To optimize server capacity and maintain database performance, the Developer reserves the right to permanently delete any user accounts, along with all associated data (including but not limited to project data, chat histories, and earned rewards), that have not been accessed for 180 consecutive days. This deletion will be performed without prior notice. The Developer shall have no obligation to restore, migrate, or compensate for any deleted data.

8. Minors and Children's Use

The Service is intended for users who are 13 years of age or older. Children under the age of 13 are not permitted to use the Service. Minors who are 13 years of age or older must obtain parental consent to use the Service.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from or in connection with the Service shall be subject to the jurisdiction of the courts having jurisdiction over the location of the Developer (unless otherwise provided by applicable consumer protection laws).

10. Third-Party Libraries and Licenses

For the purpose of enhancing gameplay and visual expressiveness, the code-generation features of the Service may generate HTML/JS templates that load open-source libraries from the following third-party CDNs:

• Target CDNs: cdn.jsdelivr.net, cdnjs.cloudflare.com, esm.sh, unpkg.com
• Common Libraries: Three.js, Phaser, PixiJS, Howler.js

These libraries are provided under their respective open-source licenses (such as the MIT License or Apache 2.0). The intellectual property rights and licenses of these third-party libraries belong to their respective authors. When hosting or commercializing generated games externally, users are responsible for complying with the licensing terms (including retaining appropriate copyright notices) of each respective library. Furthermore, the Developer makes no warranties or representations regarding the suitability, safety, compatibility, or legal compliance of any third-party libraries automatically referenced or selected by the AI-generated code. The Developer disclaims all liability for any damages or licensing disputes arising from the use of such libraries.
